If you aren’t in a position to make decisions for yourself regarding your care, wouldn’t you want to be sure someone you trust is making them for you?

Uncertain times aren’t the only time you can’t be certain about things. Consider that nobody can predict personal tragedy, death, or the inability to make decisions for themselves. As much as we’d all like a heads up before a health crisis, life doesn’t always work that way.

That’s why a healthcare power of attorney is so important, says Jay Nabors, a Cleveland-based attorney who focuses on estate planning.

“If you aren’t in a position to make decisions for yourself regarding your care, wouldn’t you want to be sure someone you trust is making them for you?” he asks.

Jay says it’s important to not only appoint a primary who is and will be in your life, it’s equally important to name a trusted secondary you know will be around, too.

“I’ve navigated several situations for people who did not have a healthcare power of attorney,” he shares. “In one case, the family began fighting about how best to care for their dad, who’d had a brain hemorrhage. After much wrangling, the court ended up having to appoint a neutral party as his guardian. I’m not sure many people would be happy knowing a stranger was making life or death decisions on their behalf.”

Jay says that now is a perfect time to get all of your important estate documents in order…your will, durable powers of attorney for healthcare and finances, and your living will.
